The jurisdiction of the Supreme Court of Bangladesh has been provided in the Constitution of the People’s Republic of Bangladesh. Article 94 of the Constitution states that there will be a Supreme Court for Bangladesh comprising the Appellate Division and the High Court Division. These two divisions of the Supreme Court have separate jurisdiction. Apart from the constitution, the sources of this jurisdiction are the general laws of the country (parliamentary law). Article 103 of the Constitution provides that the Appellate Division has jurisdiction to hear and determine appeals from judgments, decrees, orders or sentences of the High Court Division. see more job circular.
An appeal may be properly referred to the Appellate Division where the High Court Division- (a) proves that the case involves sufficient question of law as an interpretation of the Constitution; Or (b) has sentenced or confirmed the death penalty or life imprisonment of a person; Or (c) any person who has been punished for contempt of this section; And in other cases if the Appellate Division allows the appeal and also in accordance with the law of Parliament. Article 104 provides that the Appellate Division shall have the power to issue such directions, orders, decrees or writs as may be necessary to conduct a full trial in any case for the purpose of protecting the presence of any person or ordering the discovery or production of a document.
